You definitely do not want to be buying beta-stage software, and if you are installing software and discover that it is a beta version, or if it says somewhere on the CD that it is for neither resale or distribution, return it as soon as possible.

There is software that is sold as a special educational edition or that has a student license, meaning that it has been designed so that it is affordable for students and teachers. This software can only be sold by people with an educational reseller’s license orand if the buyer is an academic user. Academic software will usually indicate somewhere on the CD or during the installation that this is what it is.

OEM stands for Original Equipment Manufacturer. OEM software is only supposed to be distributed with a new computer; it comes pre-installed on the computer. A license for OEM software usually only allows it to be sold when selling it with hardware at the same time. Look for something that says “For sale with new computer only” or something similar. That said, it is probably going to be okay to bundle any OEM software you have with a computer that you are selling online.

If by chance you end up selling software that you are not supposed to be selling, then eBay could possibly close your auction, or your customers might realize what they’ve bought and give you bad feedback.
